LICENSE AGREEMENT

This license applies to the registered version of the Conformance Test Tool. You should carefully read the following terms and conditions before using this software. Unless you explicitly have a different license agreement signed by EuroDCS GmbH, your use of this software indicates your acceptance of this license agreement and the terms and conditions contained therein.

0. DEFINITIONS

  • 0.1. “Executable Form” – Any form of the SOFTWARE other than the Source Code Form.
  • 0.2. “License” – This document.
  • 0.3. “Source Code Form” – The form of the SOFTWARE preferred for making modifications.
  • 0.4. “You” (or “Your”) – An individual or a legal entity exercising rights under this License.
  • 0.5. “SOFTWARE” – The Conformance Test Tool (DLMSTT) and all accompanying documentation.
  • 0.6. “Propagation” – Copying, distribution, or making available to the public.
  • 0.7. “Defect” – When the SOFTWARE fails to meet the EuroDCS specifications to a non-negligible degree.
  • 0.8. “DLMS” – The Device Language Message Specification User Association, a non-profit organization under Swiss law.

1. LICENCE RIGHTS

1.1. Perpetual use

The Licence gives you the perpetual right to use the SOFTWARE. The unregistered version may only be used for try-out or demonstration purposes (14 days by default).

1.2. Number of simultaneous uses

The License allows the SOFTWARE to be used on one computer per license issued. Multiple users may use it consecutively on the same computer, but simultaneous use requires separate licenses.

1.3. Transfer of the Licence

The Licence may only be transferred within your organization or to other DLMS members in good standing, with written notice to EuroDCS and proper proof of transfer.

1.4. Owner of licence of previous version

Upgrading to DLMSTT implies that older products are no longer supported, and EuroDCS will not provide support or replacement keys for them.

2. PROHIBITIONS

  • Exceeding the acquired number of licenses.
  • Reproduction beyond one backup copy.
  • Renting, leasing, or lending the SOFTWARE.
  • Reverse engineering or decompiling (except as allowed by § 69e UrhG).
  • Propagating or redistributing the SOFTWARE without written permission.
  • Altering license or documentation content.

The SOFTWARE is not freeware or open source and remains the property of EuroDCS GmbH.

3. TERMS AND CONDITIONS

3.1. Warranty

The SOFTWARE is warranted for 12 months from the date of invoice. A defect exists only when usability or functionality is measurably impacted. EuroDCS will rectify defects in a timely manner.

3.2. Disclaimer of Warranties

The SOFTWARE is provided “AS IS” without warranty of performance, merchantability, or fitness for a particular purpose. The entire risk lies with the user.

3.3. Limitation of Liability

  • EuroDCS is not liable for direct, indirect, or consequential damages, including data loss or loss of profits.
  • Data loss due to non-standard operation is at your own risk.
  • The user must thoroughly test the SOFTWARE with non-critical data.
  • Liability is limited to product replacement or refund.
  • This limitation does not apply in cases of gross negligence or personal injury.

3.4. Enforcing the Licence, entire Agreement

If compliance with this License is impossible due to statute or judicial order, you must comply to the maximum extent possible and document the limitation. This License represents the complete agreement between parties.

3.5. Governing Law

This agreement is governed by the laws of Germany. Any disputes shall be handled by the competent courts of Koblenz, Germany.
